Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the Lighthouse mobile application ("App"), website, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, including the mandatory arbitration provision and class action waiver in Section 15, you may not access or use the Services.

These Services are operated by Lighthouse Media ("we," "us," or "our"). We reserve the right to update these Terms at any time. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.

2. Eligibility & Registration

2.1 Age Requirement: You must be at least 13 years old to use the Services. If you are under 18, you represent that you have your parent or guardian's permission to use the Services.

2.2 Account Creation: To access certain features, you must register an account. You may register using:

A valid email address and password (password must be at least 6 characters, containing uppercase, lowercase, and numeric characters).
Third-party authentication providers including Google Sign-In, Apple Sign-In, or Facebook Login.

2.3 Data Accuracy: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.4 Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

3. Third-Party Authentication & Permissions

3.1 Facebook Login: If you choose to register via Facebook, you authorize us to access specific information from your Facebook profile, including your public profile, email address, and birthday (user_birthday), in accordance with Facebook's Platform Terms and Data Policy. This data is used solely for identity verification and age compliance.

3.2 Google & Apple: Use of Google Sign-In or Sign in with Apple is subject to the respective privacy policies and terms of service of Google LLC and Apple Inc. We collect your name and email address from these services to create your Lighthouse account.

4. User Conduct & Community Guidelines

You agree not to use the Services to post, upload, transmit, or share content that:

Violates any law, regulation, or third-party right (including copyright, trademark, privacy, or publicity rights).
Is threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, or tortious.
Contains hate speech, nudity, graphic violence, or sexual content.
Constitutes unauthorized or unsolicited advertising, junk or bulk email ("spam").
Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including removing the offending content and terminating the account of such violators.

5. User Content & Licensing

5.1 Ownership: You retain full ownership of any text, audio, images, video, or other materials ("User Content") that you post or transmit on the Services.

5.2 License to Lighthouse: By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods (now known or later developed) solely for the purpose of operating, developing, providing, and improving the Services.

5.3 Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it.

6. Copyright Policy (DMCA)

We respect the intellectual property rights of others. It is our policy to respond to alleged infringement notices that comply with the Digital Millennium Copyright Act of 1998 ("DMCA"). If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Services, please notify our copyright agent at [email protected].

7. Privacy & Data Protection

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your data as outlined in the Privacy Policy.

8. Termination & Account Deletion

8.1 By User: You may terminate your account at any time by deleting your account in the App settings under "Account Security" or by contacting support. Upon termination, your right to use the Services will immediately cease.

8.2 By Lighthouse: We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8.3 Data Retention: Upon termination, your personal information will be deleted in accordance with our Privacy Policy, though some data may be retained in backup copies for a reasonable period of time as required by law.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

IN NO EVENT SHALL LIGHTHOUSE MEDIA, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
